William Cook v Commission [1993]

Noted that interested parties do not have consultation
rights under Article 88(3) but they do under Article 88(2).
This causes problem if court allows aid under Article 88(3)
but other party thinks Article 88(2) should have been initiated.
Court decided Article 88(2) could only be properly
safeguarded in such situation if parties were able to challenge such a Commission
decision before court.
