Wanted
to carry on operations of similar nature to those site had previously been used
for.
Planning
officer had written letter which plaintiff alleged accepted it could carry on
business without need for planning permission.
Work
on renovating factory began.
Planning
permission subsequently refused.
Plaintiff
claimed inter alia statements of planning officer estopped council from
refusing planning permission.
Court
of Appeal rejected this argument.
Planning
officer could not do what legislation required Council to do.
No
representation by officer could inhibit discharge of those statutory duties.
