sugar price had fallen.
Ship owner unaware there was market for sugar in
Basra.
Plaintiff claimed for lost profits.
House of Lords held remoteness test in contract is
narrower than remoteness test in tort.
Held remoteness centred on degree of likelihood of
loss occurring.
General tenor of judgments:
Test in contract is: Loss too remote if at time of
contract, defendant did not contemplate and could not reasonably have
contemplated that loss as a serious possibility.
However in tort only a slight possibility is required.
