Viscount Maugham:
Occupier ‘continues’ the nuisance if, once he has
actual or constructive knowledge of its existence, he fails to take any reasonable
means to abate it.
Occupier ‘adopts’ nuisance if he makes any use of the
erection, building, bank or artificial contrivance etc which constitutes the
nuisance.
