Re Lofthouse [1885]

Infant entitled to trust fund when she reached 21 or
married.
Until then trustees had power to apply all or part of
her income for maintenance and education.
Bacon V-C held he had jurisdiction to control the
discretion of the trustees, and made order directing them to pay an annual sum
to infant’s father.
Trustees then appealed to Court of Appeal.
Court of Appeal discharged the order.
Court has no jurisdiction in the matter of an infant
to make any order for payment by trustees or other persons.
