Where trust fund is established with particular
purpose, and that purpose is achieved with surplus funds remaining, has been
decided in some cases that surplus will be held on resulting trust for
contributors.
This case is an example.
Subscription fund started for support of two deaf and
dumb sisters.
No provision made for disposal of fund on death of
survivor.
Divisional Court found fund held on resulting trust by
subscribers.
