R v Cambridgeshire Health Authority, ex parte B [1995]

Doctors
of opinion that no further treatment should be given to girl suffering from
leukaemia.
Father
consulted two experts who stated that further private treatment might give slim
chance of success.
Health
authority refused to allocate funds for this and father applied for JR of
decision.
Court
of Appeal held courts not arbiters as to merits of cases of this kind.
Improper
for them to express opinions as to merits of medical judgement.
Also
improper for them to make judgments regarding health authorities’ difficult
decisions as to how limited budget is best allocated to maximum advantage.
