Only those with a proprietary or possessory interest
in the land affected can sue.
Thus, includes
– Freeholder
– Tenant in possession
– Licensee with exclusive possession
– Landlord out of possession whose interest is
affected
– Person in exclusive possession
But mere licensees cannot sue.
So lodgers, hotel guests, non-owning spouses and
children cannot sue.
