Goldman v Hargrave [1967]

Privy Council did not follow common law rule that an
occupier was not under a duty to abate a nuisance that arose from natural
causes.
Held that defendant must take whatever steps reasonable
in circumstances.
Existence of duty based on:
– knowledge of hazard
– ability to foresee consequences
– ability to abate
[ie Not an objective test.
Note far easier to find liability for omissions in nuisance
than it is in negligence]
