Employee worked for company based in UK.
Sent to Saudi Arabia, where he was injured on site.
Employers in breach of their duty to provide for
safety of employee at his place of work?
Court of Appeal held not.
Employers had a non-delegable duty to take
all reasonable care to ensure safety of employee whilst he was working
overseas.
But unrealistic to hold employers
responsible for daily events on site in Saudi, owned and managed by reliable companies.
Accident to employee not due to any breach
of duty on their part.
