Carltona v Commissioners of Works [1943]

Court
of Appeal recognised that where decisions are at discretion of Minister,
Minister does not have to personally direct his mind to matter – would be
impossible.
Decisions
can be taken by ‘responsible officers of the department’.
Minister
still of course responsible for all decisions of his department.
[Note
however that empowering statute may sometimes explicitly state that certain
functions must be exercised by Minister in person].
