Place where contract made was important in
this case.
Court of Appeal reaffirmed principle that
contract made by post is complete as soon as acceptance posted.
Contract takes place ‘in the post box’.
For instantaneous communications [eg
face-to-face, telephone, telex] contract complete only where acceptance is
heard by offeror.
Contract made at place acceptance received.
But if it is offeror’s own fault that he
does not hear / receive acceptance, and person sending acceptance reasonably
believes it has been received,
offeror clearly bound.
