Sindall plc v Cambridgeshire County Council [1994]

Seller made representation on sale of land that there
were no were rights of easement or public rights affecting property other than
as disclosed in contract.
After completion, private foul sewer found and buyer
purported to rescind.
Cost to buyer of diverting sewer very small.
Cost to seller in returning purchase price and
regaining land was very large, as value of site had halved since completion.
Court of Appeal held there was no misrepresentation,
but if there had been, would have been inequitable to order rescission, and damages
would have been ordered in lieu under s2(2) of Misrepresentation Act 1967.
