Hounslow LBC v Twickenham Garden Developments [1971]

Licensor refused equitable remedy.
Defendant company made contract that they would
prepare site ready for development.
Plaintiffs thought they were being too slow and
purported to terminate contract.
Defendants refused to accept termination and continued
to work at site.
Plaintiffs therefore applied for injunction to prevent
defendants from entering site.
Held defendants were entitled to enter site under
license implied in contract.
Megarry VC stated court would not aid plaintiff by
granting an injunction to prevent defendants entering site.
To do so would be inequitable.
Plaintiffs’ true motive was to make defendant in
breach of contract.
Irrelevant if license to enter land was not main
purpose of contract.
