Elderly woman conveyed two cottages to brother-in-law
at below market price, on oral agreement that she would be able to live
rent-free in one of them until she died.
He tried to evict her.
Court of Appeal found that he held one of the
properties on constructive trust.
Fraud to rely on the absence of writing when the
elderly woman tried to enforce her beneficial interest.
