C bought land from R without realising that L was in
fact in possession.
L had an overriding interest.
Claimant’s title was rectified to give effect to that
interest
C claimed indemnity.
Chancery Division held he was held unable to claim an
indemnity.
The rectification had caused no loss to claimant at
all.
It had merely recognised the existing legal situation.
