Nitrigin Eireann v Inco Alloys [1992]

Defendants supplied to plaintiff tubing used to
collect gases in plaintiff’s chemical production plant.
Plaintiff discovered crack in tubing in 1983.
In 1984 tubes ruptured causing explosion.
Question for court was when cause of action
arose, because this determined whether action within limitation period or not.
Court held cause of action did not arise in
1983 – cracking simply damage constituting defect in quality resulting in economic
loss irrecoverable in tort.
Physical damage of kind giving rise to
cause of action in negligence arose in 1984.
